TotalCustomers.com provides its services to the USER, subject to the following Terms and Conditions.

Websites That Are Not Accepted

Any website / URLs that has any of the following are not permitted:
* Websites with illegal, racist, or hateful content.
* Websites with content we deem to be inappropriate for our visitors.
* Phishing URLs, Trojans, Adwares, Malware, etc.
* Iframes that redirect to malicious websites.
* Websites with download prompts.
* Germany .de, Russia .ru, and India .in must target the country they originate in.
* Popups or Javascript Prompts (1 allowed on Pop-Up Traffic).
* No Stumble Upon Links.
* Adf.ly, Adfoc.us, and other PTP sites.
* Sites with clicksor ads.
* Blank landing pages.

Mistakes When Ordering
The client is responsible for any mistakes made during the ordering process. If the client provides us the wrong URL, GEO, or Industry in the beginning and notifies us of the error, we will gladly make the change. However, any traffic that was generated during the mistake will not warrant a refund..

Traffic Reporting
Every client account is setup with a Traffic Report, this allows our clients to confirm each and every customer that we send to the clients website. This Traffic Report is automatically available once the service is activated. If a client wishes to install a script for tracking on his or her website, we recommend using www.statcounter.com or www.extremetracking.com. We do not recommend using Google Analytics, Awstats, and other similar 3rd party scripts to confirm our traffic. They are not accurate with our delivery method and despite understanding clients who rely on Google Analytics, when a Shortcut is being used for a website address to monitor and record traffic Google often analyses the shortcut traffic differently and separately..

Unavailability
Should a client's website, for whatever reason, become unavailable, the client is responsible. Should the unavailability be from our traffic causing over-ordering and/or too many website visitors than the website hosting can support, the client is responsible and should make arrangements to improve hosting services. Any traffic delivered during the downtime is not refundable. It is the client's responsibility to ensure that his or her website is in working order and to stop the traffic by contacting our support if the website becomes unavailable.

Signups / Sales / Conversions
We do not guarantee a client will receive sales / signups / conversions from the customers we send. Our guarantee is that we will send the total customers our client ordered. So, if there is no sales/bookings from the customers sent, we will work with the client to better target customers but will not issue a refund unless we have offered a seperate special guarantee based on experiencing results within the first 2 months (This special Guarantee is only available with selected special offers).

Refund Policy
A client is eligible for a refund if the order was not completely fulfilled and the total customers/visitors not delivered as determined by our Traffic Report. Refunds will not be offered based on unrecommended trackers. If a client has prepaid 3,6 or 12 months in advance and the total customers/visitors was not delivered in a given month then only that month(s) that was not fullfilled will be refunded. If the full customers/visitors have been delivered then payment is not refundable.

Cancellation Policy
Subscriptions can be cancelled at any time from within a clients own PayPal account. An email reminder will be sent 1 week before automatic renewal payments are processed on 3,6 and 12 monthly subscriptions. Support email requests to cancel subscriptions must be made at least 48 hours before the renewal payment date.

Chargebacks
We honor refund requests for Undelivered months or special guarantees. If you choose to file a chargeback instead, you will owe all fees and related expenses to that chargeback. If you have an issue with any payment, simply contact us and we will do our best to resolve the issue straight away.

Limitation of Liability
The company shall not be liable for (a) any loss of use, loss of data, or interruption of business or (b) any indirect, special, incidental, consequential, or punitive damages of any kind (including, without limitation, lost profits), regardless of the form or action, whether in contract, tort (including negligence), strict liability, or otherwise, even if company has been advised of the possibility of such damages. The client acknowledges that these limitations are an essential element of this agreement, and absent such limitations, company would not enter into this agreement.

Eligibility
The Client has to be a legal entity or a natural person or an organizational unit without legal personality, with the capacity to acquire rights and incur obligations. The User must be eighteen or over or represented by someone eighteen or over to subscribe to Total Customer. Subscription in the Service is void where prohibited. By using the Site, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement.

Limited License to Background Technology
"Background Technology" means computer programming & formatting code or operating instructions developed by or for our services and used to maintain the website. Background Technology does not include any Client Content or any derivatives, improvements, or modifications of Client Content. Client may not duplicate or distribute any Background Technology to any third party without the prior written consent of Company. All rights to the Background Technology not expressly granted to Client hereunder are retained by Company.

Support
Company agrees to provide reasonable technical support to Client during Company's normal technical support hours. Company additionally agrees to provide Client service support in the form of online help desk or e-mail during Company' normal Client support hours.

No Resale of Service
You agree not to transmit, distribute, disseminate, upload, post, submit, share, store, reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the company services, use of the company services, or access to Total Customers services without the written permission of the service providers.

Proprietary Tool Limitations
The companys services are offered through the proprietary tool and processes. Client agrees to work within the limitations of the proprietary tools used and the decision of Company is final in any issue that might arise due to this.

Disclaimer and Warranties
Company warrants that the company will perform the services in material conformity to the specifications contemplated hereunder in a professional and workmanlike manner. The warranties and representations hereunder will not extend or apply to any Web site modified by any party other than through the company services'. "Error" means any reproducible error, problem, or defect resulting from an incorrect functioning of the Background Technology that materially affects the functionality of the service. You hereby acknowledge and agree that the Company will not be liable for any temporary delay, outages or interruptions of the Services.

Entire Agreement
This Agreement is the entire agreement between the parties with respect to this subject matter, and it supersedes all prior and contemporaneous discussions, negotiations, communications, and agreements with respect thereto.
